MailingBird (hereafter also "the Service") is subject to the following Terms of its Service ("Terms"). By using the Service, you are agreeing to comply with these Terms.
We reserve the right, to change, modify or otherwise alter these terms and conditions at any time. Such modifications shall become effective immediately upon the posting thereof. You will find the most recent version of these Terms any time at https://www.mailingbird.com/info/legal/.

The use of MailingBird, especially the API require members to register. Registration is initially available to anyone over 18 and limited to one registration per email address. With your registration you agree to: (a) provide true, accurate, current, and complete information about yourself (b) maintain and update the Registration Information to keep it true, accurate, current, and complete. In addition to other grounds for suspension or termination of your use, MailingBird has the right to suspend or terminate your access and refuse you any and all use of the provided Services.
After receiving your unique password, you are responsible for maintaining the confidentiality of your password and account and for logging out of your account at the end of each session. In selecting a user name, you agree that you will not: (i) select or use a screen name of another person with the intent to impersonate that person; (ii) use a name subject to the rights of any person without their authorization; or (iii) use a screen name that is offensive to people of ordinary sensitivities, illegal, or infringing. You are fully responsible for all activities that occur under your password or account. You agree (a) to notify MailingBird immediately of any unauthorized use of your password or account or any other breach of security.
MailingBird will NEVER store your submitted information, especially email-addresses to send emails or make this data available for third parties.
By signing up you agree not to post, email, or otherwise make available content:
a) That is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another's privacy, or is harmful to minors in any way.
b) That is pornographic or depicts a human being engaged in sexual conduct.
c) That harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability.
d) That is false, deceptive, misleading, deceitful, misinformed, or constitutes "bait and switch"
e) That infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party, or Content that you do not have a right to make available under any law or under contractual or fiduciary relationships.
f) That contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
g) That disrupts the normal flow of dialogue with an excessive number of messages (flooding attack) to the Service, or that otherwise negatively affects other members' ability to use the Service.
h) Collect personal data about other members for unlawful purposes.
i) Attempt to gain unauthorized access to MailingBirds's computer systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the Service.
MailingBird grants you a limited, revocable, nonexclusive license to access the Service for use, based on the current pricing. This license does not include any personal collection, aggregation, copying, duplication, display or derivative use of the Service nor any use of data mining, robots, spiders, or similar data gathering and extraction tools for any purpose unless expressly permitted by MailingBird.
Use of the Service beyond the scope of authorized access granted to you by MailingBird immediately terminates said permission or license. In order to collect, aggregate, copy, duplicate, display or make derivative use of the Service or any Content made available via the Service for other purposes (including commercial purposes) not stated herein, you must first obtain a license from MailingBird.
By using our "Advanced API", you agree to submit only email-addresses you are allowed - by your terms or other conditions - to receive additional data for.
You agree that MailingBird has the right to delete or deactivate your account, block your email or IP address, or otherwise terminate your access to or use of the Service, immediately and without notice, and remove and discard any content within the Service, for any reason, including, without limitation, if MailingBird believes that you have acted inconsistently with our Terms. Further, you agree not to attempt nor will you be able to use the Service after said deletion, deactivation, or access termination.
Developers may use the MailingBird application programming interface (API) to access information provided by the Service for their own website or software application.
Developers must abide by the terms and conditions set herein.
